Terms of Service

These Terms of Service (“Terms”) govern your access to and use of hostatto.com (“Service”). By accessing or using the Service, you agree to these Terms and our Privacy Policy.

1. Eligibility

You must be at least 18 years old to create an account or use the Service, including the free trial.

By registering, you confirm that:

  • You are 18 years of age or older
  • You have legal capacity to enter into a binding agreement

2. Description of the Service

hostatto.com provides an online platform for creating, testing, and managing an e-commerce store, including free trial access and paid subscription plans. We provide the software infrastructure, but we are not a party to any transactions between merchants (store owners) and their customers.

3. Account Responsibility

You are strictly responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities, transactions, and content uploaded, sold, or managed under your account
  • Providing customer support and handling disputes with your own buyers

We reserve the right to suspend or terminate accounts for violations of these Terms.

4. Free Trial and Account Suspension

We offer a free trial period to new users to test our platform. The following rules apply:

  • Trial Duration: If you do not upgrade to a paid plan within 15 days of starting your trial, your store will be automatically frozen.
  • Transaction & Volume Limits: During the free trial period, built-in payment modules (including Stripe, PayPal, and Invoice) are subject to strict usage limitations enforced per payment gateway. Each individual payment method is restricted to a maximum of 3 successful transactions OR a cumulative processed amount of 300 USD, whichever threshold is reached first. Once either limit is met for a specific payment gateway, that gateway will be automatically disabled for the remainder of the trial period unless the account is upgraded to a paid plan.
  • Grace Period: You will have a 20-day grace period following the suspension to upgrade to a paid subscription.
  • Data Deletion: If you fail to upgrade within the 20-day grace period, the store and all associated user data will be permanently deleted.

5. Paid Services, Fees, and Our Fair Cancellation Guarantee

  • Paid plans require valid payment information and are processed via third-party providers.
  • Subscription Plans: We offer monthly (31 days), 6-month, and 12-month plans.
  • Promotional Lifetime Plan: A special promotional offer is available for the first 300 subscribers, featuring a fixed lifetime rate of 20 USD per month.
  • No Transaction Fees: hostatto.com charges a 0% platform commission on your sales. We do not charge any core transaction fees for orders processed through your store. Any standard processing fees are solely determined by your chosen third-party payment gateways (such as Stripe). For built-in automated cryptocurrency routing features, please refer to the technical network reserves outlined in Section 6.
  • Discounts: Long-term plans include a commitment discount: 6% for 6-month plans and 15% for 12-month plans.
  • Our Fair Cancellation Guarantee (USP): Unlike other services that keep your entire payment if you sign up for a long-term plan and leave early, we only charge you for the time you actually used. If you cancel a 6-month or 12-month plan early, the long-term commitment discount is waived, and your used time is billed at our standard rate of $35 per month. The entire remaining balance of your upfront payment will be refunded straight back to your card. The initial 31 days of paid service are non-refundable.
  • Promotional Plan Early Cancellation: If a Promotional Lifetime Plan subscription is cancelled early by the user through the admin dashboard (via the “Cancel Subscription” button), the store will be immediately frozen for 20 days. The user has this 20-day window to reactivate the subscription and restore access. If the subscription is not reactivated within 20 days, the user account and all associated websites will be permanently deleted from the system, and the promotional lifetime discount will be permanently forfeited.
  • Subscription Renewal: If a standard paid subscription is not renewed, your store will be frozen for 20 days.
  • Permanent Deletion: If the subscription is not renewed or reactivated within this 20-day period (applicable to both standard and promotional plans), the store, user account, and all associated data will be permanently deleted.

6. Built-in Payment Modules

The Service provides built-in payment modules, including standard gateways and a Peer-to-Peer (P2P) cryptocurrency payment gateway. By using these modules, you acknowledge and agree to the following:

  • "AS IS" Provision: All modules and software features are provided on an "AS IS" and "AS AVAILABLE" basis without any warranties.
  • No Intermediary Liability for Crypto: hostatto.com is strictly a software provider. Regarding P2P cryptocurrency transactions, we are not a payment processor, escrow service, wallet provider, or a financial institution. We do not hold, control, or process cryptocurrency funds at any time. Transactions occur directly between the buyer and the merchant.
  • User Errors & Loss of Funds: hostatto.com shall NOT be held liable for any loss of funds resulting from user or merchant errors. This includes, but is not limited to: buyers sending funds to an incorrect wallet address, buyers selecting the wrong blockchain network, incorrect payment amounts, or blockchain network failures.
  • Indemnification by Merchant: As a store owner renting the Service, you are solely responsible for the configuration of your payment addresses and modules. You agree to indemnify and hold hostatto.com harmless from any claims, disputes, or legal actions brought by your customers regarding lost payments or unfulfilled orders.
  • Automated Crypto Forwarding & Routing Reserves: To provide maximum convenience, our built-in Bitcoin Lightning Network module features automated instant forwarding of received funds directly to the merchant’s designated personal wallet. To cover fluctuating peer-to-peer routing fees enforced by external blockchain nodes during this outbound transfer, the system automatically reserves a technical buffer of 0.8% (with a minimum baseline of 3 satoshis) from the incoming invoice amount. Any unused micro-portions of this routing reserve remain securely tied to the server-side wallet balance under the merchant's control and are not kept by hostatto.com as a platform fee.

7. Prohibited Use

You may not use the Service to:

  • Violate any local, international, or applicable laws
  • Sell illegal goods, weapons, adult content, or strictly regulated products
  • Abuse, exploit, or interfere with the platform's security and infrastructure
  • Engage in fraudulent activities or unauthorized chargebacks

8. Intellectual Property and License

All platform content, underlying software architecture, scripts, and trademarks are the exclusive property of hostatto.com or its licensors. We grant you a limited, non-exclusive, and revocable license to use the Service strictly for managing your store.

You are strictly prohibited from:

  • Attempting to decompile, reverse-engineer, or extract the source code of the Service
  • Copying, reproducing, or creating derivative works based on our platform’s logic or file system
  • Accessing the Service to build a competitive product or service

You retain full ownership of the original data, products, and specific content you upload to your individual store.

9. Copyright Infringement (DMCA)

10. Termination and Data Removal

We may suspend or terminate access immediately for violations of these Terms. Additionally, accounts and websites are subject to automatic permanent deletion following the expiration of the 20-day grace periods defined in Sections 4 and 5 (including cases of early cancellation of the Promotional Lifetime Plan).

11. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, hostatto.com, ITS CREATORS, AND ADMINISTRATORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. THIS INCLUDES, BUT IS NOT LIMITED TO, LOSS OF DATA, LOSS OF PROFITS, LOSS OF CRYPTOCURRENCY ASSETS, OR DISPUTES BETWEEN MERCHANTS AND THEIR CUSTOMERS ARISING FROM THE USE OF THE PLATFORM OR PROVIDED MODULES.

13. Governing Law and Class Action Waiver

These Terms shall be governed by the laws of Slovakia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Slovakia. YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the Service constitutes acceptance of the updated Terms.
